Terms of Service
Fennec Ship · operated by MP PARTNER LLC, 75 E 3rd St, Ste 7, Sheridan, WY 82801, USA · Last updated 2 November 2026
1. Who we are
Fennec Ship is a service operated by MP PARTNER LLC (“Fennec Ship”, “we”, “us”). These terms apply to merchants (“you”, “the seller”) who create an account at fennecship.com or connect their Shopify store to it.
2. The service
Fennec Ship helps online stores sell with cash on delivery in Spain, Portugal and Lithuania: a store builder, order management, order confirmation by phone, warehousing, shipping, cash-on-delivery collection and payouts, plus tools to run ads on your own Meta (Facebook and Instagram) ad account. Features can differ by plan and market and may change over time.
3. Your account
- You must give accurate information and keep your login details safe. You are responsible for activity under your account and your team members’ accounts.
- You must be at least 18 and able to enter into a contract for your business.
- New accounts may be reviewed before they are activated.
4. Your responsibilities as a seller
- You sell only products you are allowed to sell, that are lawful in the destination country and accurately described.
- You are the seller of record towards your customers and are responsible for consumer law, returns, warranties and taxes that apply to your sales.
- You have a lawful basis to share your customers’ order details with us so we can confirm, ship and deliver their orders.
- You do not use Fennec Ship for spam, fraud, or products that are prohibited by law, by our carriers or by Meta’s advertising policies.
5. Connecting Facebook and Instagram
You can connect your Facebook account through Facebook Login for Business. With your permission we access the ad accounts, pages, Instagram accounts and Business Managers you choose, so you can create and manage ads, see their results and receive Instagram messages in Fennec Ship.
- Ads are created in your own ad account. Meta bills you directly for ad spend; Fennec Ship does not pay for or resell ad spend.
- Your use of Facebook and Instagram remains subject to Meta’s terms and advertising policies. Meta decides whether an ad is approved and delivered.
- We store your access token encrypted and use it only to perform actions you request in Fennec Ship.
- You can disconnect at any time in Fennec Ship or in your Facebook settings. See Data deletion.
6. Fees, statements and payouts
Plan prices and per-order fees are shown in your account before you are charged. Cash collected from your customers is paid out to you after deducting the fees and costs shown on your statement. You must pay any amounts your statement shows as due.
7. Your content and data
You keep ownership of your products, store content and customer data. You give us the permission we need to host, process and display it to run the service. How we handle personal data is described in our Privacy Policy; how we process your customers’ personal data on your behalf is set out in the Data Processing Addendum in section 12.
8. Availability and changes
We work to keep Fennec Ship available, but it may be interrupted for maintenance or by events outside our control, including changes made by carriers, Shopify or Meta. We may change or discontinue features and will tell you about important changes to these terms before they take effect.
9. Suspension and termination
You can stop using Fennec Ship at any time. We may suspend or close an account that breaks these terms, puts customers or partners at risk, or has unpaid amounts. Amounts already earned or owed on either side are settled on the final statement.
10. Liability
Fennec Ship is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, or results of advertising, and our total liability is limited to the fees you paid us in the three months before the claim. Nothing in these terms limits liability that cannot be limited by law.
11. Governing law
These terms are governed by the laws of the State of Wyoming, USA, unless the law of your country requires otherwise.
12. Data Processing Addendum
This addendum forms part of these terms and applies whenever we process personal data of your customers (“Customer Data”) under the EU General Data Protection Regulation (GDPR) or similar law. You accept it when you create your account.
- Roles. You are the controller of Customer Data. Fennec Ship (MP PARTNER LLC) is your processor.
- Subject matter and duration. Order confirmation, warehousing, delivery, cash-on-delivery collection, customer messaging and store hosting, for as long as your account is open.
- Data and people concerned. Names, phone numbers, email and delivery addresses, order contents and messages of your customers.
- Instructions. We process Customer Data only on your documented instructions — these terms and your use of the service — unless the law requires otherwise, in which case we tell you first where allowed.
- Confidentiality. Everyone we authorise to process Customer Data is bound by confidentiality.
- Security. We apply appropriate technical and organisational measures (Art. 32 GDPR): encrypted connections, encrypted access tokens, restricted and logged access, backups.
- Sub-processors. You authorise the sub-processors listed in our Privacy Policy (hosting, warehouse and courier partners, Meta when you connect it). We impose the same data protection obligations on them and tell you before adding or replacing one, so you can object.
- Assistance. We help you answer requests from your customers to exercise their rights and with security, breach notification and impact assessments, taking into account the information available to us.
- Breaches. We notify you without undue delay, and at the latest within 48 hours, after becoming aware of a personal data breach affecting Customer Data.
- International transfers. Where Customer Data is transferred outside the EEA, we rely on the European Commission’s Standard Contractual Clauses or another valid transfer mechanism.
- Deletion. When your account closes we delete Customer Data within 30 days, or return it if you ask before closure, except what the law requires us to keep.
- Audits. We make available the information needed to show compliance with this addendum and allow reasonable audits, on 30 days’ written notice, at your cost.
